The offer and sale of products on the website www.vineaventis.it are governed by these Conditions of Sale, valid for each proposal, order and purchase order confirmation of the products.

Confirmation of the order by the Customer constitutes acceptance of these conditions of sale, strictly reserved for the "consumer" customer as defined by art. 3 of the Consumer Code (Legislative Decree 6 September 2005, n. 206 as amended by Legislative Decree 21 February 2014, n. 21 implementing the Community Directive "Consumers"), namely:
– any natural person acting for purposes unrelated to any entrepreneurial, commercial, artisanal or professional activity carried out.
If you do not fall into the category of "consumers" as defined above, we invite you to refrain from concluding commercial transactions on this site, specifying that they will not be taken into consideration by us.

1. Purchase methods

1.1. The General Conditions of Sale regulate all distance sales of the Products on the Site.
1.2. Through the Site, the Seller sells the Products exclusively to its end users who are "consumers", i.e. natural persons who act for purposes not related to commercial, entrepreneurial, artisanal or professional activity, possibly carried out (hereinafter the "Customer ”).
1.3. The sale of the Products on the Site is intended exclusively for persons who are at least 18 years of age in Italy and, abroad, the minimum age required by current applicable law for the purchase of alcoholic beverages. Furthermore, with the purchase order, the Customer declares and guarantees that the Customer himself and, where different from the latter, the possible recipient of the Products, are adults and possess the age required by the applicable law in force for the purchase of alcoholic beverages.
1.4. The sale of Products on the Site refers exclusively to the countries indicated in the list of shipping countries on the relevant page of the Site accessible via the Homepage.
1.5. The Seller reserves the right to establish a maximum limit of Products, or Product types, that can be purchased on the Site.
1.6. The Seller, therefore, reserves the right not to process orders from parties other than the "consumer" and/or minors, from countries not included among those indicated among the shipping countries or, in any case, to orders that do not comply to its commercial policy.
1.7. The General Conditions of Sale do not regulate the sale of goods or the provision of services by parties other than the Seller, even if they are present on the Site via links, banners or other forms of connection. It is the Customer's responsibility to verify the conditions of sale before placing orders and purchasing goods and services from parties other than the Seller. The latter is therefore not responsible for the sale of goods and/or the provision of services by third parties and/or the conclusion of agreements between the Customer and third parties.

2. PRODUCT PURCHASE ORDER
2.1. To order one or more Products on the Site, the Customer must select the Products he intends to purchase and add them to the shopping cart. Once the selection of the chosen Products has been completed, the Customer must continue with the checkout on the shopping cart web page, fill in the order form in electronic format, according to the relevant instructions, and send it to the Seller.
2.2. The languages available for completing the purchase order are those indicated, for each country, in the section relating to shipping countries accessible via the homepage of the site.
2.3. The purchase order for the Products may be placed by the Customer either through their personal account, if registered on the Site, or through the guest user mode, in this case providing the personal information required to proceed with the processing of the order. order.
2.4. The order form contains a reference to the General Conditions of Sale, as well as a summary of information on the main characteristics of each Product ordered and the relative price (including all applicable taxes or duties), the accepted means of payment and the methods delivery of the purchased Products, shipping and delivery costs, the conditions for exercising the right of withdrawal and the methods and times for returning the purchased Products.
2.5. Before proceeding with the purchase of the Products by transmitting the order form, the Customer is required to carefully read the General Conditions of Sale which he may also print, memorize or make a copy for personal use. By sending the order form, the Customer declares to have understood and approved the content of the form itself, as well as accepted the General Conditions of Sale and Use of the Site while, failing this, it will not be possible to proceed with the order. purchase.
2.6. Before transmitting the purchase order form, the Customer will be able to verify the details of the order, as well as identify and correct any data entry errors.
2.7. The submission of the order form by the Customer implies the latter's obligation to pay the price indicated in the order.
2.8. The presence of the Products on the Site must be understood as an invitation to offer from the Seller. The sending of the purchase order by the Customer to the Seller is valid as a purchase proposal for the individual Products covered by the order.
2.9. Once the purchase order has been received, the Seller will send the Customer, via e-mail, a receipt of the purchase order, which will contain a summary of the General Conditions of Sale, information relating to the essential characteristics of the Products and the indication details of the price (including all applicable taxes or duties), the means of payment, the conditions and methods of exercising the right of withdrawal and delivery costs. This e-mail is an automatic confirmation of receipt of the order and does not imply acceptance by the Seller of the Customer's purchase order.
2.10. The Customer's purchase order is considered accepted by the Seller with the sending by the latter of the email confirming the shipment of the ordered Products.
2.11. The Seller reserves the right not to accept purchase orders. This may happen, for example, in the event of unavailability of the Products or incomplete or incorrect orders, which do not give sufficient guarantees of solvency or which are contrary to the Seller's commercial policy and/or the General Conditions of Sale. In these cases, the Seller will promptly and in any case within 30 days of transmitting the order to the Seller, inform the Customer by e-mail that the contract is not concluded and that the Seller has not followed up on the order. of purchase. In the event that the Customer has already forwarded the order form and paid the price, the Seller will refund the sum paid.
2.12. The order form will be archived in the Seller's database for the period of time necessary to process the orders and in any case in compliance with the legal terms. The Customer, if registered on the Site, will be able to view the orders placed by accessing their personal account and consulting the appropriate section of the Site. The Customer who made the purchase as a "guest" user will be able to verify the orders placed by contacting Customer Service as indicated in paragraph 11 “Customer Assistance” below.

3. PRODUCT CHARACTERISTICS
3.1. Only original products marked by the Vinea Ventis brand of the Spica Agricultural Company are marketed on the Site.

3.2. The essential characteristics of the Products are presented on the Site within each Product sheet. However, the images and colors of the Products on the Site may not correspond to the real ones due to the Internet browser and/or monitor used.
3.3. Each Product is sold on the Site together with the relevant identification tag which constitutes an integral part of the Product itself.

4. PAYMENTS
4.1. The prices of the Products indicated on the Site are expressed in euros (€) and already include all applicable taxes and duties. The prices of the Products do not, however, include shipping and delivery costs which will be clearly indicated at the beginning of the Product purchase procedure.
4.2. Product prices may be subject to change. The Customer therefore undertakes to verify the final sales price before sending the relevant order form.
4.3. Payment methods can be found on the page Payments of the Site, as well as indicated in the individual purchase order form, and constitute an integral part of the General Conditions of Sale.
4.4. The price for the purchase of the Products and the shipping costs, as indicated in the order form, will be charged after sending the purchase order by the Customer and before shipping the Products by the Seller.
4.5. If payment via STRIPE is chosen, the financial information will be forwarded, via encrypted protocol, to banks or companies that provide the relevant remote electronic payment services, without third parties being able to have access to it in any way. Furthermore, this information will never be used by the Seller except to complete the procedures relating to the purchase for which it is provided and to issue the relevant refunds in the event of any returns of the Products, following exercise of the right of withdrawal, or if it is necessary to prevent or report to the police the commission of fraud on the Site.
4.6. If the Product is delivered to a country belonging to the European Union, the Product sold should not be subject to any customs clearance costs, such as import taxes and/or duties.
However, in the case of delivery to a country not belonging to the European Union, the Products sold may be subject to customs clearance costs, such as import taxes and/or duties, payable upon arrival of the Product in the country of delivery. 5. Order processing times and methods

Orders are processed from Monday to Friday. Therefore orders placed from Friday to Sunday evening are processed starting from Monday.

Vineaventis.it will deliver the products selected and ordered by the Customer via COURIER. Delivery times in Italy, according to the provisions of the art. 6 of Legislative Decree no. 206/2005, are ON AVERAGE 24 – 72 hours from the moment the completed order email is sent to the customer. For Sicily, Sardinia, Italian islands, Calabria, remote areas, Venice and disadvantaged areas, delivery may take an additional 24/48 hours, on average.

Orders received by midday will be processed the same day. For orders received after midday, the order is processed the following business day.

The recipient will receive an email from the courier which allows them to follow the shipment in real time. Vineaventis.it is not responsible for any delays in the delivery of parcels due to inconveniences caused by the courier, such as strikes, heavy traffic, problem areas, emergencies, various and possible.
Passage Notice: If the shipment cannot be delivered to the specified address, the driver leaves a notice notifying the recipient of the passage. 1. Terms of payment

Vineaventis.it offers its Customers the possibility of paying with:

1. Transport

The goods travel on behalf and at the risk of the buyer, vineaventis.it will therefore not be responsible for any delays or damages resulting from transport. 1. OFFERS AND PROMOTIONS

Any special offers or promotions proposed by vineaventis.it are valid until they expire or until the products covered by the promotion are sold out. During promotions with a percentage discount, shipping costs are always net of the discounts applied.

1. Shipments

For shipments to Italy only, VineaVentis.it does not require any costs for orders over 79.90 euros (of products). A contribution of €4.50 is requested for orders up to 79.89 euros. For shipments to Europe and outside the EU, costs are to be established based on the country.

1. Product warranties

Vineaventis.it guarantees only the material integrity of the products at the time of delivery. Any defects must be communicated by the Customer, under penalty of forfeiture, no later than 15 (fifteen) days from the delivery date. The Customer has the right to replace damaged products upon return of the same, the return shipping is paid by the buyer, excluding the Customer's right to compensation for any damage, even further. Vineaventis.it does not provide any additional guarantee on the products compared to that provided by the individual manufacturers. Without prejudice to cases of willful misconduct or gross negligence on the part of vineaventis.it, it is agreed that the liability of vineaventis.it cannot exceed the price of the products purchased by the disputed Customer.

 

 

1. Right of withdrawal

Pursuant to Legislative Decree 206/2005, the Customer has the right to withdraw from the contract and return the products ordered within 14 (fourteen) working days from receipt of the products themselves. The right of withdrawal must be exercised by the Customer, under penalty of forfeiture, by sending a registered letter with return receipt to the Spica Agricultural Company with registered office in Via Enrico Fermi nr. 40 – 25064 Gussago (Bs), within the deadlines established by law. The Customer cannot exercise the right of withdrawal in relation to personalized or bulk products. The refund will be made as quickly as possible, and in any case within 30 days from the date on which vineaventis.it will be informed, in the manner set out above, of the exercise of the right of withdrawal by the Customer. The Customer is required to send the returned Products to the vineaventis.it address within 14 working days of exercising the right of withdrawal, with traceable shipping and costs borne by the Customer.

1. Returns and refunds

The Spica Agricultural Company has thought of a very simple product return and replacement procedure, to make the online shopping experience pleasant even if the purchase is not fully satisfactory. It is possible to return any product purchased on the vineaventis.it website within 2 working days from the delivery date.

That's how:
1) The customer must ensure that the products are in the same condition in which he received them, unopened, damaged and unused.

2) You must prepare the well-sealed package, specifying the order code, personal data and email address. The package must be sent via courier or post to the address below:

4) Within 5 working days, if it is possible to replace the product, based on the goods in stock, the Spica Agricultural Company will take care of sending the replacement goods back to the Customer by courier. 1. Refunds
   The customer's return will be accepted within 5 working days from the date of delivery of the package to our warehouse, by sending the Customer a confirmation email.

The indicative times for refunds are:

• Bank transfer: the Bank will make the refund within 3 working days from when the Customer receives the confirmation email.
• PayPal/Credit Card: the refund will be visible within 24 hours from when the Customer receives the confirmation email.

 

1. Applicable law and dispute resolution

The General Conditions of Sale are governed by Italian law and in particular by legislative decree 6 September 2005 n. 206 regarding distance contracts and by legislative decree 9 April 2003 n. 70 on certain aspects concerning electronic commerce. In the event of disputes between www.vineaventis.it and each end user, arising from the General Conditions of Sale, the competent court of BRESCIA.
